JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 05-07-2023 Learned counsel for the appellants submits that the appellant no. 2 has been arrested by the police, therefore, he seeks permission to withdraw this appeal with regard to appellant no. 2.

Permission is granted.

Accordingly, this appeal with regard to appellant no. 2 is dismissed as withdrawn.

Heard learned counsel for the appellants and learned Special Public Prosecutor for the State for consideration of bail with regard to rest of the appellants.

The appellants are apprehending their arrest in a case

Patna High Court CR. APP (SJ) No.1702 of 2023(3) dt.05-07-2023 2/2 registered for the offence punishable under Sections 341, 323, 307, 354(A), 379, 504, 506, 34 of the Indian Penal Code, Section 27 of the Arms Act and Sections 3(i)(r)(s) of the SC/ST Act.

After some argument, learned counsel for the appellants seeks permission to withdraw this appeal.

Permission is granted.

Accordingly, this appeal is dismissed as withdrawn. However, if the appellant surrenders before the learned court below within a period of six weeks from today and prays for regular bail, the same shall be considered by the learned court below on the same day without being prejudiced by this order.
