JUSTICE VINOD KUMAR SINHA ORAL ORDER 25-07-2018 Earlier prayer for bail of the petitioner was rejected by this Court vide order dated 17.04.2017 passed in Cr. Misc. No.17684 of 2017 and vide order dated 18.10.2017 passed in Cr. Misc. No.50801 of 2017.
It has been submitted on behalf of the petitioner that there is no allegation of rape with the victim girl, as the F.I.R. itself shows that it is the co accused, who tried to commit rape with the victim girl and on hulla by the victim girl, it is the petitioner, who opened the door and allowed the girl to come out. Further the petitioner is a lady and has been in custody since 09.02.2017. Heard learned A.P.P. also.
Having heard both sides, in view of the above facts, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned
Patna High Court Cr.Misc. No.45047 of 2018 (2) dt.25-07-2018 2/2 Additional District & Sessions Judge -IVth, Gaya, in connection with Sessions Trial No.95 of 2017 (542 of 2017) arising out of Tekari (Panchanpur) P.S. Case No. 46 of 2017, subject to the following conditions:- (i) One of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court.
(ii) The petitioner will not induce any witness or tamper with the evidence.
(iii) The petitioner shall cooperate in the disposal of trial and make herself available as and when required by the court and on the event of failure on her part to appear before the court below on two consecutive dates without showing any genuine reasons, the prosecution is free to move for cancellation of her bail.
