Petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 406, 419, 420, 467, 468, 471, 120B/34 of the Indian Penal Code. The prosecution case is that mother of one Padma Chaudhary executed a gift deed in favour of her daughter to the extent of 45 acre 91 decimal of land. Subsequently one Pramila Devi impersonating herself as Padma Chaudhary executed two sale deeds in favour of Nilima Ranjan and said Nilima Ranjan transferred the said land through registered sale deed in favour of petitioner No. 3 wherein petitioner Nos. 1 and 2 are identifier.

It is submitted by learned counsel for the

Patna High Court Cr.Misc. No.27716 of 2015 (2) dt.27-07-2015 2/2 petitioners that thrust of accusation is against Pramila Devi and petitioners are simply bona fide purchaser and witnesses. It is submitted by learned counsel for the informant that petitioner No. 1 identified Pramila Devi as imposter of Padma Chaudhary who is wife of his brother in law(sala).

Considering the nature of accusation and the thrust of accusation against Pramila Devi, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi in connection with Dumra P.S. Case No. 351 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
