JUSTICE SANDEEP KUMAR ORAL ORDER 11-11-2024 This appeal has been filed for setting aside the judgment and order dated 24.01.2019 passed in Special Case No. 16 of 2017 arising out of Jalalgarh P.S. Case No. 81 of 2017 by the learned Sessions Judge-cum-Special Judge (NDPS) Act, Purnea, by which appellant has been convicted for an offence punishable under Section 20(b) Clause (ii) Sub Clause (B) of the NDPS Act and acquitted from the charges under Section 22 of the NDPS Act and awarded sentence of rigorous imprisonment for period 5 years and a fine of Rs. 50,000/- for offences under Section 20(b) Clause (ii) Sub-Clause (B) of NDPS Act and in default of payment of fine convict shall further undergo imprisonment of one year.
