JUSTICE SUDHIR SINGH ORAL ORDER 28-09-2015 Heard learned counsel for the petitioners and the State. The petitioners are apprehending their arrest in a case instituted under Sections 304B, 498A/34 of the Indian Penal Code. Allegation against the petitioners is of torturing and killing daughter of the informant due to non-fulfilment of demand of dowry.

It has been submitted on behalf of the petitioners that petitioner no. 1 is Bhaisur, petitioner no. 2 is father-in-law and petitioner no. 3 is Gotia of the deceased. Petitioners have got no criminal antecedents. Husband of the deceased is in custody. Petitioners are separated from mess and property of the husband of the deceased.

On behalf of the State, it is submitted that the petitioners are named in the F.I.R.

Considering the aforesaid facts and circumstances, let the above named petitioners, in the event of arrest or surrender in the

Patna High Court Cr.Misc. No.27756 of 2015 (3) dt.28-09-2015 2 / 2 court below within a period of four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Bihar Sharif, Nalanda, in connection with Harnaut P.S. Case no. 42 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
