The petitioner seeks bail in a case registered for offences under Sections 30 (a) of the Bihar Prohibition and Excise Act, 2016.

It is contended that, as per allegation, 677.160 litres of foreign liquor was recovered from the different vehicles standing in the lonely place from where the petitioner was seen fleeing away seeing the raiding police party but he was arrested by the police on chase. It is further contended that the petitioner is accused in one other case, i.e., Matihani P.S. Case No. 06 of 2017 registered for the

Patna High Court Cr.Misc. No.53495 of 2017(2) dt.09-11-2017 2/2 offences under Section 414/34 IPC in which he has been granted anticipatory bail by a Co-ordinate Bench of this Court. Petitioner claims that he is in custody since 05.09.2017.

Considering the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-VII-cumSpecial Judge, Excise, Begusarai in connection with Cheriabariyarpur P.S. Case No. 133 of 2017 with a condition that if the petitioner, after his release in this case, is again found to be involved in criminal case of similar nature, the court concerned would be at liberty to take steps for cancellation of his bail bonds.
