Petitioner is in custody since 21.07.2016 in connection with S.Tr. No. 217 of 2016/114 of 2016 arising out of Daudnagar P.S. Case No. 259 of 2014 registered under Sections 147, 148, 149, 323, 326, 302, 307 and 504 of the Indian Penal Code. Learned counsel for the petitioner has submitted that the petitioner, who is of clean antecedent, is innocent and has not committed any offence. Earlier a report was called for from the concerned court below and in compliance thereof the report has come stating that the charges against the petitioner has been framed and 4 to 6 months will consume in concluding the trial as 16 witnesses have to be examined. The petitioner is rotting in judicial custody for the last six months.
Patna High Court Cr.Misc. No.58764 of 2017 (3) dt.24-01-2018 Considering the facts and circumstances of the case, this Court is not inclined to grant regular bail to the petitioner at this stage, accordingly, the prayer for bail of this petitioner is rejected. However, the petitioner may renew his prayer for bail after six months, if the trial is not concluded within six months.
