Counter affidavit has been filed on behalf of the State, in which, it has been submitted that the petitioner retired from the post of Panchayat Secretary on 31.01.2018 but due to nonsubmission of the required essential documents before the Administrative Officer, the payment of the admitted outstanding dues have not been ascertained.

It has been informed by the son of the petitioner to the

Patna High Court CWJC No.8628 of 2021(5) dt.24-01-2023 2/2 counsel that the petitioner is presently in custody. In this background, this application is disposed off with a direction to the petitioner that upon release from jail, he shall file all the required documents before the authority i.e. respondent no. 6, who shall ascertain his retiral dues within 8 weeks, thereafter and shall assure all the admissible dues to him within 2 weeks, thereafter.

In case of non-payment of his admissible dues within the time prescribed above, the petitioner shall be entitled to receive 9% interest on the payable amount and it shall be realized from the pocket of respondent no. 6 i.e. by the State. (Dr. Anshuman, J.) ashishsingh/- U
