JUSTICE ARUN KUMAR ORAL ORDER 27-07-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 8.4.2018, seeks bail in Keoti PS Case No. 202 of 2017 registered under Sections 302/34, 120B of the IPC and Section 27 of the Arms Act. Learned Counsel for the petitioner submits that the petitioner is not named in the FIR though there are named accused persons in the FIR, besides this the petitioner had no enmity with the deceased and seeks bail on the ground of parity as another co-accused similarly situated Mohan Yadav was earlier granted bail by this Court vide Cr. Misc. No.
32488 of 2018 and only material transpired against the petitioner is disclosure of his name by Mohan Yadav and Nanhku Yadav regarding his participation in the crime, but Bharat Yadav who was along with the deceased has not named the petitioner in his statement, besides this the petitioner has no criminal antecedent.
Having considered the said facts and circumstances, the petitioner, namely, Sudhir Yadav is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of ACJM VII, Darbhanga in connection with Keoti PS Case No. 202 of 2017.
