The petitioner apprehends his arrest in connection with Spl. Case No. 1142 of 2018 arising out of Palasi P.S. Case No. 273 of 2018 for the office registered under Section 272, 273 of the Indian Penal Code and Section 30 (a) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in the present case. It is further submitted that name of the petitioner has surfaced on the basis of the confessional statement made before the police by co-accused, namely, Md. Samshad. It is further submitted that the petitioner is not named in the first information report and he has no

Having considered the facts and circumstances of the case, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail on personal bond to the satisfaction of the 2nd Additional Sessions cum Spl. Judge, Araria in connection with Spl. Case No. 1142 of 2018 arising out of Palasi P.S. Case No. 273 of 2018, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
