Petitioners apprehend their arrest in Complaint Case
Patna High Court CR. MISC. No.16347 of 2020(2) dt.16-11-2021 2/2 No.292C of 2018 registered under Sections 323, 341, 147, 380, 379, 307, 354(B) and 34 of the Indian Penal Code but cognizance has been taken under Sections 323, 341, 354, 504 and 379 of the Indian Penal Code.
Learned counsel for the petitioners submits that the petitioners have committed no offence and have falsely been implicated in the present case. It is further submitted that the complainant filed a complaint case against the petitioners, that too, after 25 days of the alleged occurrence. The petitioners have got no criminal antecedent.
Having considered the facts and circumstances of the case, the petitioners, above named, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on personal bonds to the satisfaction of learned A.C.J.M. V, Araria in connection with Complaint Case No.292C of 2018, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
