JUSTICE MOHIT KUMAR SHAH ORAL ORDER 16-09-2022 The grievance of the petitioner in the present case is that despite the petitioner having filed an appeal bearing Encroachment Appeal No. 4/2019-2020 before the Collector, Nalanda against the final order passed by the Circle Officer, Parwalpur, District-Nalanda at Biharsharif in connection with Encroachment Case No. 7/20172018, neither the said appeal is being disposed of nor the Respondent-State is restraining itself and instead, a notice dated 1.3.2021 has been issued by the Circle Officer, Parwalpur, District-Nalanda at Biharsharif, directing the petitioner to remove the encroachment in question.

Patna High Court CWJC No.8714 of 2021(2) dt.16-09-2022 2/2 In such view of the matter, I deem it fit and proper to dispose of the present writ petition with a direction to the Collector, Nalanda at Biharsharif to dispose of the aforesaid Encroachment Appeal No. 4/2019-2020, expeditiously and till the disposal of the same, it is directed that status quo, existing as on today qua the house / land of the petitioner in question, shall be maintained.
