Petitioner apprehends his arrest in a case registered under section 379 of the Indian penal Code. The prosecution case, in short, is that a motorcycle of younger brother of the informant bearing No. BR26G-2086 was stolen away while it was parked at the compute institute.
On behalf of the petitioner it is submitted that petitioner has no criminal antecedent. Petitioner is not named in the first information report and in course of investigation it is said that the stolen motorcycle is said to have been recovered from the joint house of the petitioner. Except this there is no other

On behalf of the State it is submitted that petitioner is named in the first information report. Considering the aforesaid facts, the above named petitioner in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of Chief Judicial Magistrate, Aurangabad in Town P.S. Case No. 88 of 2015, subject to the conditions as laid down under section 438(2) Cr.P.C.
