JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 24-01-2018 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Perused the report of learned 7th Additional Sessions Judge, Bhagalpur and it is obvious from the aforesaid report that the trial of the petitioner is pending for cross-examination of investigating officer. The learned trial court has sent a vague report and it has not been mentioned in the report as to how many witnesses have been left to be expedited and what would be expected time to be taken by him for conclusion of trial of the petitioner.
Since the deceased has specifically leveled allegation of litting fire on her by the petitioner, who happens to be husband
Patna High Court Cr.Misc. No.60907 of 2017 (3) dt.24-01-2018 2/2 of the deceased. I am not inclined to release the petitioner on bail and hence, his prayer for bail in connection with Kotwali P.S.Case |No. 751 of 2014 & Session Trial no. 384 of 2015, pending in the court of learned Session Judge, Bhagalpur is again rejected. However, the learned trial court is directed to conclude the trial of the petitioner within four months from the date of receipt/ production of copy of this order at any cost even by taking stern action against investigating officer as well as against those prosecution witnesses, who are not appearing before the trial court for deposition.
