The petitioner seeks bail in Nirmali P.S. Case No. 113/2016 instituted for the offences under Sections 498, 304-B, 201/34 of the Indian Penal Code.
The earlier bail application of the petitioner was rejected vide Annexure-1 to the present application taking into account that the petitioner is husband of the deceased and, as such, the onus is on him to explain the cause of death of his wife.
A report was called for from the Court below regarding the stage of the case. It has been reported that the case has been committed to the Court of Sessions. A discharge
Patna High Court CR. MISC. No.20575 of 2019(4) dt.04-09-2019 2/2 application has been filed on behalf of the petitioner and for the said reason, the charge has not been framed in this case. Considering the nature of accusation and the stage of the case, I am not inclined to grant bail to the petitioner. The same is rejected. The Trial Court is directed to take necessary steps to dispose of the discharge application at the earliest in accordance with law and conclude the trial at the earliest preferably within one year from the date of receipt/production of a copy of this order.
