The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections 341, 354(a) and 506/34 of the Indian Penal Code and Sections 8/12 of the POCSO Act, 2012.

It is a case of outraging the modesty of the informant/victim by co-accused Deepak Kumar.

Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. He further submits that the main allegation of outraging the modesty is against co-accused Deepak Kumar and not against this petitioner and the petitioner has no direct concern of outraging the modesty of the informant. Patna High Court CR. MISC. No.17883 of 2022(2) dt.19-09-2022 2/2 accused Deepak Kumar, the name of the petitioner has been implicated in this case. Petitioner has clean antecedent. Learned APP appearing for the State has opposed the anticipatory bail of the petitioner.

Considering the aforesaid submissions, let the petitioner, above named in the event of his arrest or surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM, Bihar Sharif (Nalanda) in connection with Khudaganj P.S. Case No. 124 of 2021, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
