2. Petitioner apprehends arrest in a case registered for the offence punishable under Section 30 (a) , 37 of Bihar Prohibition and Excise Amendment Act 2018 .
3 . It is alleged that 180 ml of English wine was recovered from seized vehicle and petitioner is alleged to be owner of the seized vehicle .
4. It is submitted that the petitioner is innocent and has falsely been implicated in this case . As a matter of fact, the driver of the seized vehicle without knowledge and consent of this petitioner used the vehicle in transporting the alleged liquor. Petitioner has got no concern with the alleged recovery and he was not present at the time of occurrence . No incriminating
Patna High Court CR. MISC. No.19688 of 2025(2) dt.17-04-2025 2/2 material has been recovered from the conscious possession of the petitioner. Petitioner claims clean antecedent. 5 . Learned counsel for the State opposes the bail petition .
6. Considering the quantity of recovery , clean antecedent of petitioner and other circumstances of the case , in the event of arrest/surrender within six weeks from today, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive special Excise Court No. 1 Gaya in connection with Muffasil Police Station Case No. 1118 of 2024 , subject to the conditions laid down under section 482 ( 2 ) of the Bharatiya Nagarik Suraksha Sanhita ( BNSS) , 2023 .
