Petitioner is apprehending his arrest in Chewara P.S.Case No.13 of 2013 registered for the offences under Sections 341, 323, 504, 353/34 of I.P.C.
Allegation against the petitioner is of forcing the informant to make attendance of forged boys in attendance register in order to obtain government benefit.
Submission of the learned counsel for the petitioner is that she is not named in the F.I.R. but during course of investigation her name transpired. No specific allegation is attributed to the petitioner.
Heard learned A.P.P. also.
Having heard both sides and in view of the facts and
Patna High Court Cr.Misc. No.48372 of 2018 (2) dt.23-08-2018 2/2 circumstances, as stated above, let the petitioner, above named, in the event of her arrest or surrender before the court below within a period of six weeks from today, be released on bail on furnishing bail bond of Rs.25,000/- with two sureties of the like amount each to the satisfaction of Addl.C.J.M.-III, Sheikhpura, in Chewara P.S. Case No.13 of 2013 subject to the conditions as laid down under Section 438(2) of Cr.P.C. and (1) one of the bailors must be a local person having sufficient immovable property within the jurisdiction of the concerned court. (ii) the petitioner will not induce any witness or tamper with the evidence and the petitioner shall co-operate in the investigation of the case and make herself available as and when required by the police, otherwise, the prosecution is free to move for cancellation of her bail bond.
