The petitioners seek regular bail in connection with Special Case No. 6736 of 2017 arising out of Patlipura P.S. Case No. 332 of 2017 for the offences punishable under Section 30(a),38(i), 41(i)(2) of the Bihar Prohibition and Excise Act, 2016. The allegation is regarding recovery of 30 liters of illicit liquor from the motorcycle being driven by the petitioners herein.

The learned counsel for the petitioner submits that the fact is that no recovery has been made from the person of the petitioners, the petitioners have a clean antecedent and are in custody since 6.10.2017.

No.62906 of 2017 (2) dt.17-01-2018 2/2 Considering the nature of accusation, the period of custody already undergone and the fact that the petitioners have a clean antecedent, the petitioners, above named, are directed to be released on bail on furnishing bail bonds of Rs. 10,000/- each with two sureties of the like amount each to the satisfaction of learned Special Judge cum ADJ VIII, Patna in connection with Special Case No.6736 of 2017, arising out of Patliputra P.S. Case No. 332 of 2017.
