It is the stand of the counsel representing the university that the regulation does not talk in terms of any special or internal examination for a candidate who may have failed to appear in the examination already conducted for the one reason or the other. The only option left for the petitioner would be to sit for the examination (8th semester, internal examination), when it is scheduled next with the next batch.

Counsel for the petitioner submits that he

Patna High Court CWJC No.9006 of 2015 dt.20-08-2015 2/2 should be permitted to sit for the said examination, so that he can complete his studies even though it means loosing out of sometime because of reason totally beyond his control.

Stand of the petitioner, therefore, is now in conformity with the position taken by the university. The university shall allow the petitioner to sit for the examination (8th semester, internal examination) with the next batch, if there is no other impediment in his way. Writ application is disposed off with observation as above.
