The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 307, 302, 504 and 506 of the Indian Penal Code. It is a case of assault upon the informant by means of lathi causing head injury by the accused persons. It is submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in this case. He further submits that the main allegation of assault is against coaccused Niranjan Yadav who is said to have given fatal blow on the head of the deceased. He further submits that similarly situated co-accused persons have already been granted anticipatory bail by a Co-ordinate Bench of this Court passed in

Patna High Court CR. MISC. No.17877 of 2022(2) dt.19-09-2022 2/2 Cr. Misc. No. 10119 of 2021. Petitioner has clean antecedent. Learned APP appearing for the State opposed the anticipatory bail.

Considering the aforesaid submissions, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM, Sherghati, Gaya in connection with Sherghati P.S. Case No. 205 of 2020, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
