The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 332, 337, 338, 333, 307, 354, 327, 504, 506 of the Indian Penal Code.

As per FIR, the allegation against the accused persons including this petitioner is that they were creating hindrance in juvenile remand home and they also tried to snatch rifle from constables. It is further alleged that accused persons also assaulted staffs of the prison due to

Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case. The petitioner is a juvenile prisoner and he was only protesting against mismanagement and he was not indulged in any violence. Similarly situated co-accused has already been granted bail by a coordinate Bench of this Court vide order dated 29.05.2023 passed in Cr. Misc. No. 14769 of 2023. It is further submitted that injury sustained by staffs is simple in nature. The petitioner is languishing in judicial custody since 19.11.2022.

Learned APP appearing for the state has opposed the prayer of regular bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as custody of the petitioner, this court is inclined to enlarge the petitioner on bail.
