JUSTICE SUDHIR SINGH ORAL ORDER 02-08-2017 Learned counsel for the petitioner seeks permission to withdraw the present application with a liberty to prefer an appeal before the State Appellate Authority, challenging the order dated 13.01.2012, passed in Case No. HC-112 of 2010 by the Member, District Teacher Employment Appellate Authority, Vaishali, which is under challenge, in this writ application.

Patna High Court CWJC No.4027 of 2012 (4) dt.02-08-2017 Permission is accorded.

The petitioner shall file an appeal within a period of thirty days from the date of the order and the same shall be disposed of within the statutory period, in accordance with law. It has further been pointed out by learned counsel for the petitioner that the petitioner was granted interim relief by this court vide order dated 01.03.2012. The petitioner will be at liberty to file separate application for grant of any interim relief, if so advised, during the pendency of the appeal, within a period of ten days from the date of filing of the appeal. The said application filed by the petitioner shall be disposed of within a period of twenty days.

The present application is disposed of with the aforesaid observation and direction.
