This is an application for bail in connection with Town (Aurangabad) P.S.Case No. 240 of 2017 registered for the offences punishable under Sections 399, 402, 414 of the Indian Penal Code and 25(1-B), 26 and 35 of the Arms Act. Allegation is of recovery of one loaded country made pistol from the petitioner while accused persons were preparing for committing dacoity and police arrested the petitioner. Submission of learned counsel for the petitioner is that he has falsely been implicated in this case and he is in custody for four months. Further submission is that he is accused in one more case and he is on bail in that case also.

Having heard both sides and in view of facts and

Patna High Court Cr.Misc. No.53097 of 2017 (2) dt.15-11-2017 2/2 circumstances, I am not inclined to grant bail to the petitioner at this stage.

However, once charge has been framed in this case, learned trial court shall release the petitioner on bail to its own satisfaction on the condition that he will co-operate in trial. With the above observation, this application is disposed of.
