Case i.e., Pakribarawan P.S. Case No. 469/2025; therefore, they are being heard together and disposed of by a common order.

2. Heard the learned counsel for the petitioners, the learned APP for the State and the learned counsel for the informant.

3. The petitioners seek regular bail in connection with Pakribarawan P.S. Case No. 469/2025 instituted for the offences under Sections 126(2), 115(2), 352, 351(2), 118(2), 109, 303(3) read with Section 3(5) of the Bharatiya Nyaya Sanhita.

4. It is alleged that the petitioners along with others assaulted the victim. While some accused persons have been named in the FIR, others have been implicated during the course of investigation. The occurrence is stated to have arisen out of a caste dispute and it is alleged that the informant was brutally assaulted by the accused persons.

5. The petitioner, namely Kundan Chauhan is in custody since 14.12.2025 and has eight criminal antecedents whereas the petitioner namely Pawan Chauhan is in custody since 04.02.2026 and has six criminal antecedents. The allegations against the petitioners are serious and grave in nature. There exists prima facie material against both the petitioners indicating their involvement in the commission of the offence.

6. Having considered the facts and circumstances of the case, the allegations levelled against the petitioners and the genesis of the occurrence, this Court is not inclined to grant regular bail to the petitioners.

7. Accordingly, both these applications for regular bail stand rejected.

8. It is made clear that any observation made herein is prima facie in nature and limited solely for the purpose of adjudication of the present bail application. Such observations shall not be construed as an expression on the merits of the case and shall not influence the trial or any other proceedings in any manner.
