The petitioners seek regular bail in connection with Rishiyap P.S. Case No. 05/2023, registered for the offence punishable under Sections 30(a)/42 of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioners submit that the petitioners are innocent and falsely been implicated in this case. No incriminating article has been recovered from the possession of the petitioners. Petitioners are in custody since 10.01.2023. Learned APP has vehemently opposed the prayer for

Patna High Court CR. MISC. No.23546 of 2023(2) dt.15-05-2023 2/2 bail.

Considering the nature of allegation levelled against the petitioners, their period of custody, this application is allowed.

Let the petitioners, above named, be released on bail, on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise-II, Aurangabad in connection with Rishiyap P.S. Case No. 05/2023.
