The submission of the counsel for the petitioners is that the objections and the stand taken by Nagar Nigam, Ara has already been decided with regard to the entitlement of pension and post retiral dues in a proceeding instituted against Ara Municipal Corporation. The necessary decision of the Hon'ble Apex Court is the case of Sanchari Devi vs. Ara Municipal Corporation, reported in 2015(1) PLJR 370(SC).
The writ application is dispose of with the direction that the claim of the petitioners would be considered and decided by the
Patna High Court CWJC No.12974 of 2014 dt.22-05-2017 2/2 respondent Ara Municipal Corporation in terms of the law laid down by the Apex Court in the case of Sanchari Devi (supra). The decision must be taken within a period of four months from the date of production of a copy of this order.
