The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 363, 366A of the Indian Penal Code.

The prosecution case is that the minor daughter of the informant and the minor daughter of one Bhagwan Mandal were kidnapped.

It is submitted by learned counsel for the petitioner that under Section 164 statement one of victim girls Minu Kumari stated that she married with co-accused Ranjit Kumar in a temple whereas the other victim Rupa Kumari married with Sanjit Kumar. Statement under 164 Cr.P.C. of Rupa Kumari suggests the thrust of accusation against Ranjit Kumar. Though, the victim Minu Kumari under Section 164

Patna High Court Cr.Misc. No.28956 of 2015 (2) dt.27-07-2015 Cr.P.C. got her age recorded 18 years, the Court also assessed her aged 18 years where as the Rupa Kumari got her recorded as 15 years, but the court has assessed her aged 16 years. It is further submitted that the victims have not named the petitioner Rajendra Ravidas and the father of main accused Ranjit Kumar has been granted bail vide Cr. Misc. No. 21724 of 2015.

Considering the fact that the victims have not named the petitioner, let the above named petitioner be released on bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhagalpur in connection with Jagdishpur P.S. Case No. 29 of 2015, subject to conditions as laid down under Section 438(2) of the Indian Penal Code. (Dinesh Kumar Singh, J) P.K./- U T
