JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 02-11-2020 Heard learned counsel appearing on behalf of the petitioner and learned counsel appearing on behalf of the State. The petitioner is in custody in connection with Khodawandpur P.S. Case No. 214 of 2018 for the offence under Section 392 of the Indian Penal Code.

Learned counsel for the petitioner would submit that the petitioner was not named in the first information report and his name surfaced on the confessional statement of co-accused Chandan Kumar. He further submits that other co-accused persons including the person who disclosed the name of the petitioner have been granted bail by coordinate Benches of this Court vide orders dated 04.12.2019 and 01.05.2019 passed in Cr. Misc. No. 68132 of 2019 and Cr. Misc. No. 18077 of 2019

Considering the fact that the petitioner was not named in the FIR; he has not been put on T.I. parade; other similarly circumstanced co-accused persons have been granted bail; and he is in custody since 25.01.2020, the Court is inclined to grant bail to him. The petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of SDJM, Manjhaul, Begusarai in connection with Khodawandpur P.S. Case No. 214 of 2018.
