The petitioner apprehends his arrest in Hajipur SC/ST P.S. Case No. 7 of 2015, registered for the offences punishable under Section 379 and other Sections of the Indian Penal Code and under Sections 3(i)(x) of the SC/ST Act.

The informant made allegation that while he was on the gate of Vaishali Block, the petitioner came abused the informant by naming his caste and also assaulted him with fists and slaps and the petitioner also snatched the diary and Rs. 4600/-. It is submitted that the petitioner is the husband of the Mukhiya and that is why he has falsely been implicated in the case.

On perusal of the FIR itself, it appears that the

Patna High Court Cr.Misc. No.28083 of 2015 (2) dt.24-07-2015 2/2 occurrence took place at the gate of Block Office and the petitioner is alleged to have abused the informant by naming his caste and assaulted him. Considering the facts aforesaid, I am not inclined to enlarge the petitioner above named on anticipatory bail. Accordingly, the same is rejected.
