The petitioner is apprehending her arrest in a case registered for the offences punishable under Sections 341, 323, 448, 379, 504/34 of the Indian Penal Code and 3/4 of the Prevention of Witch Craft Practices Act. It is alleged that co-accused Munna Sah abused the informant for practicing witch craft on his daughter, who is suffering from illness. It is further alleged that Munna Sah and this petitioner assaulted the informant and daughter of the informant and snatched jewellary and cash of Rs. 3,000/-.

Learned counsel for the petitioner submits that the petitioner is agnate of the informant. For the

Patna High Court Cr.Misc. No.28955 of 2015 (2) dt.27-07-2015 occurrence of 02.04.2015 at 9.00 A.M. the First Information Report was registered on 03.04.2015 at 2.30 P.M. Admittedly, no visible injury was found on the informant.

Considering the nature of accusation and petitioner being a lady, let the above named petitioner be released on bail in the event of her arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Sikrahana at Motihari in connection with Patahi P.S. Case No. 47 of 2015, subject to conditions as laid down under Section 438(2) of the Indian Penal Code.
