JUSTICE MOHIT KUMAR SHAH ORAL ORDER 09-11-2017 Heard the learned counsel for the petitioner. The petitioner seeks regular bail in connection with Nathnagar (Madhusudanpur) P.S. Case No. 403 of 2017 for the offences punishable under Sections 364 'A' of the Indian Penal Code.

The allegation in the written information of the informant is that his younger brother was kidnapped and a demand of ransom of Rs. 1,50,000/- was made.

The learned counsel for the petitioner submits that as far as the petitioner is concerned, she is an old lady and she is said to be the mother of the kidnapper and no allegation whatsoever has been levelled against her as well as she has a clean antecedent. Having regard to the facts and circumstances of the

No.53174 of 2017 (2) dt.09-11-2017 2/2 case, the petitioner, above named, is directed to be enlarged on regular bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate 1st, Bhagalpur in connection with Nathnagar (Madhusudanpur) P.S. Case No. 403 of 2017. It is made clear that grant of bail to the petitioner may not be construed as an expression of any opinion on the merits of the case as far as the other two accused persons are concerned.
