JUSTICE SHIVAJI PANDEY ORAL JUDGMENT Date: 07-07-2017 Heard learned counsel for the petitioner and learned counsel for the State.

In this case, the petitioner is seeking payment of Rs.8,52,344/- with 18% compound interest as claim has been made that he has constructed the building of High School, Mali, Ramgardh, Arwal.

Learned counsel for the petitioner has drawn the attention of this Court to the recommendations of different level of Engineers and even the Executive Engineer has recommended for

Patna High Court CWJC No.19887 of 2016 dt.07-07-2017 2/2 payment. He further submits that the District Education Officer, sent a letter dated 08.09.2015 to the Director, Secondary Education, Bihar, Patna, for allotment of the funds as the founds are not available and on account of that the payment has not been made. Let the petitioner file a detailed representation before the Principal Secretary, Education Department, Government of Bihar, Patna. If such an application is filed, the Principal Secretary, Education Department, will be obliged to look into the matter and see that admitted dues would be paid to the petitioner without unnecessary delay. If he does not agree with the claim of the petitioner, in such circumstance, he will be obliged to give proper hearing to the petitioner and pass a reasoned order. The entire exercise should be completed by the Principal Secretary, Education Department within a period of four months from the date of filing of application by the petitioner.

With the aforesaid observations and directions, this writ application is disposed of.
