====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 17-10-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State.
The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 147, 149, 283 and 353 of the Indian Penal Code and Sections 5 and 6 of E.S.M. Act. The informant alleges that on 25.10.2018 at 10:30 AM while he was performing his duty when he got information about a loaded truck with animals has been apprehended by Bishwa Hindu Parishad workers for which a case was lodged and the truck was seized, it is next alleged that after the incident, 14 named accused persons including the petitioner and 50-60 unidentified accused started blocking the road after which when the informant went to stop the occurrence the accused persons misbehaved with the police team and raised slogan against them and prevented the official from doing their work and even obstructed the traffic.

No.18321 of 2022(3) dt.17-10-2022 2/2 Learned counsel for the petitioner submits that petitioner has antecedent of one case and has been falsely implicated in the present case, it is next submitted that similarly situated co-accused Shankar Paswan has been granted anticipatory bail by order dated 13.08.2019 in Criminal Misc. No. 35627 of 2019. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.
Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Goraul P.S. Case No. 348 of 2018 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
