The petitioner seeks bail in connection with Suppi P.S. Case No. 267 of 2020 dated 14.08.2020 registered for the offence punishable under Sections 498A, 506 of the Indian Penal Code and 3⁄4 Dowry Prohibition Act.
The prosecution case, in short, is that informant gave a written report to S.H.O., Suppi Police Station alleging therein that she got married with petitioner and soon after the marriage, petitioner and his family members started demanding dowry of Rupees 4 lakhs and one Super Splendor motorcycle and they were not ready to bring back the informant to her matrimonial house. It is further alleged that on 14.08.2020 the petitioner
Patna High Court CR. MISC. No.18655 of 2023(2) dt.16-05-2023 2/3 came at her naihar and brutally assaulted informant due to which she became unconscious.
Learned Counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. It is submitted that the petitioner never demanded dowry from the informant or from her family members. Further, from perusal of the impugned order, the marriage of petitioner was solemnized with the younger sister Meenu of the informant but the informant was sent in her place as wife fraudulently by the parents of the informant as the informant is not of sound mind and so the petitioner cannot take risk to keep the informant in his residence as wife because there is chance that she may take some unusual step which may be dangerous to the petitioner and his other family members. The petitioner is in custody since 07.10.2022, is a person with clean antecedent and charge-sheet has been submitted in the case.
Learned A.P.P for the State opposes the prayer for bail of the petitioner.
Considering the facts and circumstances of this case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) only with two sureties of the like amount each to the satisfaction of the
