JUSTICE SUDHIR SINGH ORAL ORDER 29-09-2015 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in a case instituted under Sections 302 and 201 of the Indian Penal Code and Section 27 of the Arms Act.

As per FIR, it is alleged by the informant that the informant found a dead body of a young person near Kiul river. The people arrived there. Nobody identified the dead body of the deceased. The informant claimed that unknown miscreants killed the deceased.

It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. The petitioner is not named in the FIR. The name of the petitioner has come in course of the investigation. One Ruga Devi in her 164 Cr.P.C. statement

Patna High Court Cr.Misc. No.28111 of 2015 (4) dt.29-09-2015 has raised suspicion against the petitioner, except for this there is no other substantive piece of evidence.

On behalf of the State, it has been submitted that the name of the petitioner has come in course of investigation. Considering the aforesaid facts, let the above named petitioner, in the event of his arrest or surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Lakhisarai in connection with Lakhisarai P.S.Case No.501 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
