====================================================== CORAM: HONOURABLE MR. JUSTICE VINOD KUMAR SINHA ORAL ORDER 24-07-2018 Heard learned counsel for the petitioner and learned APP for the State.

The petitioner apprehends his arrest in connection with Naugachia P.S. Case No. 154 of 2004, registered for the offences punishable under Sections 406 and 420 of the IPC and 138 of Negotiable Instrument Act.

As per F.I.R. the allegation against the petitioner is that the informant was dealing in grains and other goods and the petitioner requested to supply maize to Shiv Public Poultry Farm and Sunil Poultry Farm on the assurance of prompt

Patna High Court Cr.Misc. No.42746 of 2018(2) dt.24-07-2018 2/2 payment and the petitioner issued a cheque in favour of the informant but the cheque was dishonoured due to insufficient fund.

Submission of the learned counsel for the petitioner is that a compromise petition has already been filed between the parties and the dispute has already been settled, which is reflected from para 12 of this petition and petitioner has no criminal antecedent.

Learned APP opposes the prayer for bail.

Having heard both sides and in view of the facts and circumstances, as discussed above, let the petitioner, above named surrender within a period of six weeks and the learned court below shall examine as to whether there is any proper compromise petition on record, if it is so, he will release the petitioner on bail to his own satisfaction, otherwise he is free to pass any order as deemed fit proper.

This application is accordingly disposed of.
