JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 02-06-2020 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. This application for grant of regular bail arises out of Bangaon P.S. Case No.120 of 2019 registered for the offence punishable under Section 304/34 of the Indian Penal Code. The brother of the deceased is the informant. Petitioner is the wife of the deceased. The son and the daughter of the deceased have also been made accused. Allegedly, because of some domestic dispute, the petitioner had hit the deceased with lathi in his head. Similarly, allegedly, the son of the deceased, Rohit Kumar, also assaulted the deceased with bamboo stick in his head.

Learned counsel for the petitioner has drawn my attention to the postmortem report to submit that there is only one injury found in the head of the deceased, which falsifies the

Patna High Court CR. MISC. No.16129 of 2020(2) dt.02-06-2020 2/2 case of the prosecution. He has submitted that the brother of the deceased has falsely implicated the family members of the deceased for ulterior reasons.

Be that as it may, considering the nature of allegation and the fact that the petitioner, a lady, is in custody since 04.10.2019, this application is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-I, Saharsa, in Bangaon P.S. Case No. 120 of 2019.
