Petitioner seeks bail in Excise Case No.434 of 2017 arising out of Korma P.S. Case No.43 of 2015 instituted for the offence under Section(s) 272, 273 Indian Penal Code and Section 47(a) of the Bihar Excise Prohibition Act. Counsel for the petitioner submits that recovery has been made from the open field as mentioned in the written report.

It is alleged that 110 litres country made liquor along with utensils and earthen pot were recovered. Petitioner is in custody since 21.01.2019.

In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner,

Patna High Court CR. MISC. No.20993 of 2019(4) dt.29-05-2019 2/2 above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the 2nd Additional Sessions Judge, Sheikhpura, in connection with Excise Case No.434 of 2017 arising out of Korma P.S. Case No.43 of 2015, subject to the condition that both the bailors shall be close relative of the petitioner.

Further, (i) the petitioner will remain present on each and every date of trial, (ii) His absence on two consecutive date(s) without any reasonable cause will make his bail bond liable to be cancelled, and (iii) the petitioner will not intimidate the witnesses in any way and will not hamper the trial.
