Heard learned counsel for the petitioner and learned APP for the State.

The petitioner in the present case is seeking regular bail in connection with Bhagwanpur P.S. Case No.233/2020 registered for the offences under Section 393 of the Indian Penal Code and under Sections 25(1-b)a / 26/ 35 of the Arms Act. The petitioner has one criminal antecedent. He is in custody since 05.12.2020.

Earlier the prayer for bail of the petitioner was withdrawn granting liberty to seek his remedy in accordance with law vide order dated 06.07.2021 passed in Cr.Misc.No.

Patna High Court CR. MISC. No.18718 of 2022(2) dt.28-09-2022 2/3 29540 of 2021.

Learned counsel for the petitioner submits that the petitioner has remained in custody for one year eight months and the trial has not progressed.

Learned APP for the State has though opposed the prayer for bail of the petitioner but does not dispute the aforesaid submission.

Having regard to the nature of the allegations and the custody of the petitioner since 05.12.2020, this Court directs release of the petitioner above named on bail on furnishing bail bonds of Rs.25,000/- (Rupees Twenty Five Thousand Only) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-V, Kaimur at Bhabua in connection with Bhagwanpur P.S. Case No.233/2020, subject to the conditions as laid down under Section 437(3) Cr.P.C.

And further condition that the court below shall verify the criminal antecedent of the petitioner and in case at any stage it is found that the petitioner has concealed his criminal antecedent, the court below shall take step for cancellation of bail bond of the petitioner. However, the acceptance of bail bonds in terms of the above-mentioned order shall not be
