====================================================== CORAM: HONOURABLE THE CHIEF JUSTICE ORAL ORDER 10-08-2017 This application has been filed alleging noncompliance with an order passed on 27.01.2011 in Criminal Writ Jurisdiction Case No. 45 of 2008. The direction issued in the writ petition was to transfer of Miao P.S. Case No. 40 of 2008 to the officer-in-charge, Bihta Police Station, District-Patna. Inter alia contending that this order has not been complied with, this application has been filed more than five years back on 10.04.2012 and when the mater was taken up on 27.06.2012, notices have been issued to the respondent No. 4. There is nothing available on record to indicate as to what action
Patna High Court MJC No.1919 of 2012 (4) dt.10-08-2017 2/2 has been taken for transfer of the case. The petitioner is also not present and records indicate that none is appearing for the petitioner since 27.06.2012. It seems that petitioner is no more interested in the matter. Now, after more than five years, I see no reason to initiate action for contempt. In case, the petitioner has any grievance still subsists with regard to the issue in question, liberty shall be available to the petitioner initiate fresh proceedings, in accordance with law.
With the aforesaid, the application stands disposed of.
