Petitioner is in custody in connection with Belhar P.S. case No. 208 of 2017 for the offence under section 302 of the Indian Penal Code.

Learned counsel for the petitioners submits that there is no eye-witness. The petitioner and co-accused Horil Yadav was suspect in the instant case. Co-accused Horil Yadav was granted bail by a coordinate Bench of this Court after perusal of the case diary.

Learned counsel for the State admits that the allegation against this petitioner is identical to the case of coaccused Horil Yadav who has been granted bail by a coordinate Bench of this Court in Cr. Misc. No. 21805 of 2018 vide order

Patna High Court Cr.Misc. No.35562 of 2018(3) dt.24-07-2018 2/2 dated 10.05.2018.

Considering the above, let the petitioner, named above, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-IIIrd, Banka, in connection with Belhar P.S.
