2. Petitioner apprehends arrest in a case registered for the offences punishable under Sections 420, 406, 467, 468, 469, 120(B) and 471 of the Indian Penal Code.
3. According to F.I.R., this petitioner is alleged to have defalcated the money of the depositors to the tune of Rs. 23,92,450/-.
4. It is submitted that the defalcated amount has already been deposited by the petitioner to the concerned authorities and only the interest amount i.e. Rs. 9143/- is still left to be paid. Petitioner has got clean antecedent.
5. Considering the facts and circumstances of the case, this anticipatory bail is allowed and it is ordered that let
Patna High Court CR. MISC. No.21613 of 2024(2) dt.04-04-2024 2/2 the above named petitioner in the event of his arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Gopalganj in connection with Gopalganj (Town) P. S. Case No. 545 of 2018, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure with further condition that: (i) Petitioner shall pay the remaining amount of Rs. 9143/- to the concerned authorities at the time of furnishing the bail bond, failing which the learned court below shall be at liberty to cancel the bail bond of the petitioner.
