Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 419, 420 of the Indian Penal Code and Section 10 of the Bihar Examination Act, 1981.
The prosecution case is that one Ravi Kumar was appearing in place of the petitioner at the constable recruitment examination, 2014.
It is submitted by learned counsel for the petitioner that petitioner had no knowledge about Ravi Kumar appearing in his place in the examination and even assuming the accusation, at best the case under Section 419 of the Indian Penal Code is made out which is bailable. Moreover nongrant of bail to the petitioner will jeopardize the carrier of the
Patna High Court Cr.Misc. No.31043 of 2015 (2) dt.04-08-2015 2/2 petitioner.
A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. Considering the aforesaid facts, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nawada in connection with Nawada Town(Bundelkhand) P.S. Case No. 636 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
