Petitioner seeks bail in Mirganj P.S. Case No.333 of 2018 instituted for the offence under Section(s) 272, 273 Indian Penal Code and 30(a), 37(b) (c) of Bihar Prohibition and Excise Act, 2016.

It is alleged that 144 litres foreign liquor has been recovered from the vehicle. Driver of the vehicle, Munna Sahani was apprehended. Two persons sitting on the vehicle managed to run away. The chowkidar disclosed their names as Prem Parwat and Ash Mohammad. Name of this petitioner has come during investigation being owner of the vehicle. Counsel for the petitioner submits that petitioner was not present at the spot. He has no concern with the aforesaid

In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the 2nd Additional Sessions Judge cum Special Judge, Excise, Gopalganj, in connection with Mirganj P.S. Case No.333 of 2018, subject to the condition that both the bailors shall be close relative of the petitioner. It appears that one more case under the Excise Act is pending against the petitioner. The petitioner will file an Affidavit at the time of his furnishing bail bond that he will not indulge in such activities in future, otherwise, his bail bond in the instant case will liable to be cancelled.
