The petitioner is in custody in connection with Paraiya P.S. Case No. 13 of 2020 under sections 147, 148, 341, 323, 324, 307, 427, 379 and 353 of the Indian Penal Code. As per the FIR, the informant has alleged that amongst other it was the petitioner herein who gave 'sword' blow on the head of his brother causing injury to him. He further submits that other accused persons also assaulted him as also damaged his vehicle. It was only with the intervention of the police, the alleged 'Jaam' was removed and the informant and others saved themselves.

Taking into account the fact that specific allegation

No.18623 of 2022(2) dt.27-07-2022 2/2 has been made against the petitioner herein who has inflicted 'sword' injury on the head of the informant's brother in January, 2020 whereas the petitioner chose to come into judicial custody two years later on 5.1.2022, this Court is not inclined to grant him the privilege of bail which is accordingly rejected.
