JUSTICE BIRENDRA KUMAR ORAL ORDER 30-01-2018 Heard learned counsel for the petitioner and learned APP for the State.

Petitioner seeks bail in a case registered for the offences punishable under Sections 420, 471, 468, 354(B), 354(C), 354(D) and 34 of the Indian Penal Code. Submission of the learned counsel for the petitioner is that in fact the informant is legally wedded wife of the petitioner vide joint affidavit sworn by both of them on 14.01.2015 and certificate of marriage granted by the Temple, where the marriage was performed dated 28.03.2014 enclosed with the supplementary affidavit. He further submits that the Aadhar Card of the informant and other proofs of her identity as well as the material to substantiate that both were working in the same office are

Patna High Court Cr.Misc. No.53704 of 2017 (5) dt.30-01-2018 attached alongwith the supplementary affidavit. In the aforesaid background, allegation in the FIR is that the petitioner cheated to the informant and sexually harassed her.

Considering the aforesaid material, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Mahila Police Station Case No.87 of 2016, subject to the condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
