JUSTICE ARUN KUMAR ORAL ORDER 16-01-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody, seeks bail in Ahiyapur PS Case No. 621 of 2017 registered under Sections 364A of the IPC. Learned Counsel for the petitioner submits that the petitioner is not named in the FIR, the allegation is that material has transpired that Kailash Kumar who had kidnapped the victim, both were acquainted with each other. The only allegation against the petitioner is that Kailash stayed for one day along with the victim in the house of the petitioner. The petitioner has no criminal antecedent.
Having considered the said facts and circumstances, the petitioner, namely, Sushil Kumar Yadav is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of CJM Muzaffarpur in connection with Ahiyapur PS Case No. 621 of 2017.
