JUSTICE SUDHIR SINGH ORAL ORDER 21-08-2017 In the present writ application, the petitioner has sought for direction for setting aside the order dated 18.12.2011 as contained in Memo No.4280 issued by the District Magistrate, Gaya, whereby he held that the engagement of the petitioner on the post of Panchayat Shiksha Mitra thereafter absorption on the

Patna High Court CWJC No.1778 of 2012 (5) dt.21-08-2017 2/2 post of Panchayat Shikshak was illegal as the petitioner was not in service on 01.07.2006, and accordingly directed the appointing authority to take appropriate decision for terminating the service of the petitioner and by treating the said post as vacant to make fresh appointment as per Panchayat Shikshak Appointment Rule, 2006.

The petitioner is directed to file an appropriate application for redressal of his grievance before the District Appellate Authority, Gaya within a period of thirty days from the date of the order and the same shall be disposed of within the statutory period.

With the aforesaid observation and direction, the present writ application stands disposed of.
