The petitioner apprehends his arrest in connection with Forbesganj P.S. Case No.961 of 2018 registered under Sections 420/34 of the Indian Penal Code besides Sections 7/19 C (I), (II), (VI) and 21(a) of the Bihar Fertilizer Control Order. The accusation is that on receiving secret information about the preparation of duplicate fertilizer, the S.D.P.O., Forbesganj and B.D.O., Forbesganj, made raid in the residential campus and seized the packets of duplicate fertilizer. It was also detected that the said residential campus was belonging to Amar Kumar Das, in the godown of which, the business of illegal fertilizer was being done and the petitioner used to help to Amar

Patna High Court CR. MISC. No.16850 of 2019(3) dt.23-05-2019 2/2 Kumar Das in doing the business of illegal fertilizer. Learned counsel for the petitioner submit that while the petitioner is named in the F.I.R. but the only allegation against him is that he used to help to Amar Kumar Das in doing the business of illegal fertilizer.

Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender by him within six weeks from today, be enlarged on bail on his furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Sub Divisional Judicial Magistrate, Araria, in connection with Forbesganj P.S. Case No.961 of 2018, subject to the conditions laid down under Section 438(2) Cr.P.C.
